Terms of Service

These terms are an agreement between you and Built By Dusty, based in Tyler, Texas ("Built By Dusty", "we", "us"), which operates Kennel Press at kennelpress.com, app.kennelpress.com and breedsites.com (the "Service"). By creating an account or using the Service you agree to them. If you use the Service for a business, you agree on that business's behalf.

1. What Kennel Press is

Kennel Press lets animal breeders ("you") build and host a website about their breeding program: their animals, litters, story, and a way for buyers to contact them. We host the website on a breedsites.com address or, on paid plans, on a domain you own.

We are a website service. We are not a party to any sale, deposit, reservation, adoption or transport of an animal. We don't verify animals, pedigrees, health results or titles, and we don't handle money between breeders and buyers.

2. Accounts

• You must be at least 18 and able to form a binding contract.
• Give accurate account details and keep them current. We confirm your email address before your website can be published. We may add a step, such as verifying a mobile phone number or reviewing your website, and these terms will say so when we do.
• Keep your password secure. You're responsible for activity on your account. Tell us at support@kennelpress.com if you think it has been misused.
• One person or business per account. Don't create accounts by automated means.

3. Plans, payment and cancellation

• Plans. Each plan includes what the pricing page says when you subscribe. Limits, such as the number of animal profiles, active litters and photos, are enforced by the Service and may change; we'll give you at least 30 days' notice before reducing what a paid plan includes.
• Billing. Paid plans are billed in advance, monthly or yearly. Payments are handled by Stripe through Stripe Managed Payments, which charges you, issues your receipts and invoices, and collects and pays sales tax where the law requires it. Prices are shown before you pay. Paid plans are available to customers in the United States.
• Renewal. A paid plan renews automatically at the end of each period until you cancel. You can cancel any time from Plan and billing; you keep the paid plan until the end of the period you've paid for.
• Refunds. Payments are non-refundable except where the law requires otherwise. If something has gone wrong, write to us and we'll look at it fairly.
• Failed payments. If a renewal fails, Stripe retries it. If it still fails, your site moves to the free plan.
• Moving to a lower plan. We never delete your content because your plan changed. If you have more animals, litters, pages or photos than the lower plan allows, we keep your most recent ones on your website up to the limit and take the rest off your public site. They stay in your account. You can't add more until you're within the limit again, by upgrading or by deleting some yourself. A connected domain pauses and your free address keeps working.
• Founding-breeder pricing. A founding price given by promotion code lasts as long as that subscription stays active; it ends if you cancel.
• Done-for-you setup is a one-time service. We refund it in full if you cancel before we start work; once work has started it is non-refundable.
• Price changes to a paid plan apply at your next renewal after at least 30 days' notice.

4. Your content

• You own your content: text, photos, pedigrees and anything else you add. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, resize and adapt it (for example to make thumbnails and search previews) only to run, show and promote your website and the Service. The licence ends when you delete the content or your account, except for copies in backups for a limited time and anything already shared publicly by others.
• Marketing. We won't use your content in our own marketing without your permission.
• You're responsible for your content. You confirm you have the right to publish everything you upload, including photos taken by others and the words of families you quote, and that it is accurate, including health results, titles and registrations.
• AI-assisted features. If you use a feature that drafts text or reads a pedigree for you, what it produces is a suggestion. Nothing is published until you review it, and you are responsible for what you publish.

5. Rules for breeder websites

Puppy and kitten scams are common, and they hurt buyers and honest breeders. You agree not to:

• advertise animals you don't have, or take deposits for animals that don't exist;
• use other breeders' photos, words, names or logos without permission;
• impersonate another breeder, kennel, cattery or business;
• ask buyers to pay through methods designed to avoid buyer protection or traceability, such as gift cards or wire-transfer services, or charge invented fees (for example "crate", "shipping insurance" or "pet insurance" fees);
• publish false health testing, titles, registrations, pedigrees or testimonials;
• break any law that applies to breeding, selling, advertising or transporting animals where you or your buyers are;
• upload malware, spam, or anything illegal, hateful or sexually explicit;
• try to break, overload or get around the Service's security or limits.

6. Screening, reports and enforcement

• We automatically check website text for wording often used in payment scams, and for animals listed as available with no location. A match can hold a site back from being published while we review it.
• Anyone can report a website. We review reports.
• We may remove content, take a website offline, suspend or close an account, or refuse service if we reasonably believe these terms are broken or buyers are at risk. Where we can, we'll tell you why and let you respond. If we close an account for breaking these terms, we don't refund the rest of a paid period.

7. Inquiries from buyers

Your website's contact form sends buyers' messages to your account email. You're responsible for how you use buyers' details: only to answer them, and as the law requires. We keep a copy of each inquiry for 90 days so you have it if an email goes astray and so we can deal with abuse, then delete it.

8. Custom domains

On a paid plan you can connect a domain you own. You're responsible for registering and renewing it and for its DNS. If your site leaves the paid plan, your domain stops showing your website until you upgrade again, and your breedsites.com address keeps working.

9. Search engines

We build your website to be easy for search engines to read. We don't promise any ranking, traffic or number of inquiries. Websites are offered to search engines only once they meet our verification and content checks.

10. Availability and changes

We work to keep the Service available but don't guarantee it will be uninterrupted or error-free. We may change or discontinue features. If we discontinue the Service entirely we'll give at least 60 days' notice and a way to export your content.

11. Ending your account

You can close your account by emailing support@kennelpress.com. Your website goes offline and we delete your content within 30 days, except what we must keep for legal, tax or abuse reasons (for example payment records).

12. Disclaimers

The Service is provided "as is". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We're not responsible for dealings between breeders and buyers.

13. Limitation of liability

To the extent the law allows, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US$100, and we're not liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue or data.

14. Indemnity

You'll defend and indemnify us against claims arising from your content, your website, your animals or your dealings with buyers, or your breach of these terms.

15. Disputes

These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Smith County, Texas, and you and we consent to their jurisdiction. Either of us may bring a qualifying claim in small-claims court instead.

16. Changes to these terms

We may update these terms. For material changes we'll email account holders at least 30 days before they take effect. Continuing to use the Service after that means you accept them.
